    Default Pistol Grip shotguns in NYS

    I have been told by several gunshops that it is illegal for someone with a NYS pistol permit to own/purchase a strictly pistol grip shotgun, yet I have found nothing in the Penal Code to prohibit it? Law or Gunstore policy?

    You don't have to have a pistol permit to have a pistol grip shotgun. Just because it has a pistol grip doesn't make it pistol. What gun shops told you that so I can avoid them?

    You can own a pistol grip shotgun in NY state. You can go right into most stores and get a Mossberg Persuader with a pistol grip. If it's a pump shotgun you're good to go, nothing illegal about it.

    If it's a semi-auto you have to comply with the assault weapons ban...

    (b) a semiautomatic shotgun that has at least two of the following
    characteristics:
    (i) a folding or telescoping stock;
    (ii) a pistol grip that protrudes conspicuously beneath the action of
    the weapon;
    (iii) a fixed magazine capacity in excess of five rounds;
    (iv) an ability to accept a detachable magazine;

    Thruway Market in Walden, and Collector Guns and Ammo in Hopewell. And just to be stupid how bout a strictly pistol grip rifle(no stock what so ever)? For example a Saiga .308

    As long as it's a 16" barrel and meets the overall length requirement of 26" I don't see why it would be illegal.

    If it's semi-auto you would have to comply with the assault weapon ban though.

    thats an awesome loop hole in NYS law, it can have no stock, but not a folding or collapsable.

    Yea isn't it. You can have a collapsible stock permanently fixed in the shortest position but not one that collapses. :

    Not to mention the rationale behind it was because it would make a rifle more concealable but it would still have to be 26" long.

    That's what happens when idiots make laws.

    wait is a strictly pistol grip "rifle" or "shotgun" still intended to be fired from the shoulder? if not then its considered a firearm and its illegal class a misdemeanor.

    definitions, and criminal possession of a weapon in the fourth degree, clearly states any firearm, definition of firearm doesnt state the weapon has a stock soo, but the definiton of rife and shotgun say the weapon is intended to be fired from the shoulder.

    I see what you're reading now.

    I'm no lawyer but I would say any shotgun or rifle was "intended to be fired from the shoulder" even if it has no shoulder stock on it.

    For the sake of argument, if you would not call it a rifle or shotgun because it's not intended to be fired from the shoulder, what would you call it?

    I just noticed there don't define pistol or revolver in the definitions.

    AOW? I would like to find out what those definitions are too. Its hard enough to obey laws that make no sense, but its darn near impossible when you can't understand the laws. But the general thought is a pistol grip shotgun is legal so thats good news for me. Thanks guys

    i dont think new york has AOW in the laws. They have disguised gun which it definitely would not be.

    I dunno. I would still say it's legal according to the intent of the law even if the exact literal wording is a little fuzzy. Like I said though, I'm no lawyer.

    Why would you even be bothered with this subject? Pistol grips on a
    shotgun look cool as hell,,,,,,,,,,, However,,, if you want to use it as
    a defense weapon,,, forget the pistol grip, they are useless on a
    shotgun that you actually intend to use,,,,,, they only get in your way,
    are cumbersom under stress, and they punish the hand and wrist that
    is gripping the grip :'(

    but they look cool 8)

    Ron is right. I have a pistol grip shotgun and have it mostly for the look, I don't like it anyways, if you're getting a self defense firearm get a regular stocked shotgun or one w/ a folding stock w/ the pistol grip.
