    i gave this article a quick scan, but it seems to make valid points. i wonder if any of these points will be argued in court?

    They keep calling our modern semiauto rifles assault weapons they better let us actually make them assault weapons and be done with it.

    Wouldnt mind me the occasional 3 round burst... That too much to ask?

    the troublesome part for me is that it would preclude anyone 45 yrs and older from owning. Not sure I buy that one. Thoughts?

    Max has stated that they are trying to avoid using the milita argument.

    Seems a real stretch to be honest, and I do think the militia argument is not one that will find much sympathy. The constitution is not technically decided by general opinion, but the justices are people. They know the US has a military and the national guard and thus far arguing 2nd based on personal rights to self-defense has worked best.

    I'm with you on that, I turn 45 next year; would that mean that I wouldn't have the right to bear arms since I'm not active National Guard and the age for militia is 17 to 44?

    This would open us up to a whole new problem with age and ower ship. But at the same time it would also make the argument that we the people can own anything the government can weapon wise. Not saying I need an f-22 raptor or could afford one but this argument would allow for it.

    GREAT read. Here's the "TL; DR" version:

    Conclusion

    Irrespective of the pronouncements by legislators at the state and federal level, the right of citizens to possess a “military type” firearm existed prior to and independent of the Constitution or the subsequent adoption of the Second Amendment. The Framers of the Constitution embedded this right in the “arming” provision of Clause 16. Thus, neither government has the general authority to modify or negate it through a legislative act.

    I think for the people that are concerned about the age 45 part are reading to much into that how im reading it is you be in a militia up to the age 45 but you still have a right to protext life liberty and the pursuit of happiness

    My (if I owned one) AR is no more a "military style weapon" than a car with a rear spoiler is a "drag racing type car."
