    Default Buying a long guy in NYS while being out of state

    Hi, I just moved to NY (back actually) and a few of my buddies became avid hunters. I just took my hunter safety course for NY and went to go purchase a long gun (Savage 308) at Dick's Sporting Goods, as they had one on sale that I really liked. I currently have a Florida Driver's license. They said they couldn't sell the gun to me being that I was from out of state. I called Gander Outdoors and posed a similar question and they told me I needed proof of NYS residency to buy a fire arm. I'm buying a house here in NY but I don't close until the 27th, I can't get a NYS id or change my car insurance, etc until I close on my house. Am I really not able to buy a hunting rifle with an out of state ID and background check? Thank you.

    Certainly no federal regulation prevents you from it. There may be a NYS regulation - I am not sure.

    I believe one solution might be to go to PA and buy a long gun there.

    Go to a gun store and ask them. The big box stores have multiple store policies preventing that. However when buying a gun they do ask me everytime
    lately is this your current address?
    Mad OTR stayed it’s not a federal law and of the gun is legal in state of purchase and residence you can technically buy it. I’d say it’s more of a store policy and call a small local shop and see what they say.

    New York, NJ and PA have reciprocity in gun sales. Florida does not. Unfortunately you cant buy until you have established residency. If you own a rifle in Florida you may be able to bring it in as long as itís compliant.

    According to Federal law, you only need a background check to purchase long guns. However, it seems that states can put restrictions in place... but it is not clear or easy to find if NY has restrictions. There needs to be clear references cited.
