    Default NICS delay

Howdy gents. Apologies if I’m missing this somewhere in the forum. To keep it short. I scored a sweet Black Friday deal on an upper. I want to keep it as legit as possible so the flash hider was removed and replaced with a thread protector which was welded on the barrel. From there i purchased a NYS compliant stock and filed the necessary paperwork for a lower i was planing on purchasing. My NICS was delayed. No biggie. But 30 days later it is still delayed. Speaking to some friends that deal with firearm sales. This appears to be a frequent occurrence. I have no criminal record, and the closest I’ve ever dabbled in the criminal world would be the occasional traffic ticket(haven’t had one in quite a few years). I guess what’s next? Just hang tight, cancel it and just figure something else out? I really just wanted to build a rig to take to the range and plink on some steel. But to be honest this is very discouraging.

From what I understand that if the NICS is delayed, you are then required to wait the 30 days. If you donít come back denied the firearm should be good to go. Talk to your FFL

AFAIK, the law is 3 days to release a gun after getting a delay. Now, some dealers may make their own rule, not law, if they feel queasy.

New law went into place. Delay = automatic 30 days. Then must re-apply.

I went through the same thing with a rifle I bought online. I was delayed the full 30 days with no answer. I had it ran again and while i waited i filled an appeal with the number the FFL provided me. Another 30 days went by with nothing. The FFL said with the new laws they couldn't transfer. I figured 3x a charm ran again and called an attorney. I have since sent the rifle back but the attorney informed me..."after the first 30 days NY requirements were met and rerunning it legally could have taken possession after the federal 3 days." So I guess it's up to the FFL either way it's INFRINGEMENT!!!
